On Thursday, March 4, 2010 at approximately 1:49am, Officer Monico Segovia responded to a request to speak to an officer at the Kennedy's residence at 701 N. 16th.
When Segovia arrived at the residence he spoke to the Kennedy's about three individuals coming to their door just a few minutes earlier looking for Weston Barrett.
Weston Barrett, reported that these three had contacted him while standing in front of a local convenience store just before midnight and demanded that he get into the vehicle with them.
Barrett continued to report that the three drove him around the city and as they were driving around they were threatening him with violence to the point of pointing a firearm at him. He was being accused of taking some "weed" that one of them had accidentally dropped in the parking lot in front of the store.
Barrett said that he was then told that he would have to get into the Kennedy house and take one 360 X-Box and X-Box from Kennedy's house and bring that to them for payment for the bag of "weed" that they said that they were missing.
The 360 X-Box was taken outside and placed on a car sitting in the Kennedy's drive-way and
he then ran back inside of the Kennedy's house and hid due to the fact that he was suppose to steal a X-Box and the X-Box 360 that would serve as payment for the "weed" that he was accused of taking from them.
Officer Segovia around 5:00am located one of the three at his residence. At that point when he was questioned he denied any threats towards anyone that they just went to the Kennedy's house looking for Barrett and even apologized for waking up Mr. Kennedy.
On Wednesday, March 10th, Officer Segovia was discussing the case with Sgt. Skinner who was actively working a burglary from auto since March 4 in that same general area where property was stolen, filed for a search warrants for two residences, one at the apartments at 600 S. 15th and the other for a residence at 107 N. 14th both in Frederick.
These two search warrants were executed simultaneously at around 2:00pm that afternoon.
The search at the apartment was unsuccessful but the stolen 360 X-Box belonging to the Kennedy's, was discovered at the residence on 14th Street.
The two adults were arrested on Thursday, March 11, evening on warrants for Probation Violations and transported to the Tillman County jail and incarcerated. On Friday the 17 year old juvenile suspect was taken into custody and transported to the Juvenile Detention Center in Lawton to be detained. All three were additionally charged with; Kidnapping for Extortion, Cause,Aid,Abet,Encourage a Minor to Participate in Drug Related Crime, Criminal Conspiracy to Commit A Felony (1st Degree Burglary), Possessing a Weapon While Committing a Felony and Feloniously Pointing a Weapon at Another.
